Massachusetts Man Used Online Auction to Distribute Infringing Products
Novell, Inc. announced that it has recovered an estimated $20 million worth of its software products being offered illegally on the Internet by Peter Bosworth of Attleboro, Massachusetts.
Novell investigators discovered the products, which included various versions of NetWare, GroupWise and BorderManager, among others, on eBay's auction site during their regular course of monitoring the Internet. Investigators say they acquired the products Bosworth was auctioning after determining the products were not authorized for distribution. Novell then contacted Bosworth and recovered the remaining products in his possession, all of which infringed upon Novell's copyrights. "Most of the Novell products we have seen offered through these auction sites have turned out to be illegitimate in one way or another," stated Harrison Colter, associate general counsel for Novell. "We will continue to fight this battle to protect the best interests of Novell and its customers." Novell investigated over 2400 cases worldwide in fiscal 1999. More than $11 billion each year is lost to software piracy, according to the Business Software Alliance (BSA) and the Software& Information Industry Association (SIIA). Novell is an active member of both the BSA and SIIA. Novell has established an anti-piracy group and telephone hotline for reporting illegal use of Novell software or making related inquiries.
