California Companies Pay Novell $750,000
Novell, Inc., a leading provider of Net business solutions, today announced that it has reached a settlement in its case against Cableware Technology, Inc. and MJ Systems, Inc., both of City of Industry, CA. Novell brought a suit against Cableware Technology and MJ Systems in May of 1999 for copyright and trademark infringement.
The settlement includes a permanent injunction against Cableware Technology and MJ Systems, as well as a cash payment of $750,000, already received by Novell. The two companies, both of which are principally owned by the same individual, Michael Jen, have conducted operations out of the same location. Jen was also listed as a defendant in the case.
In the lawsuit, filed in the U.S. District Court for the Central District of California, Novell alleged that the defendants produced counterfeit Novell software and labels, illegally repackaged Novell® software, and distributed stolen software. Novell further alleged that the defendants illegally used Novell's trademarks to publish misleading advertisements about the type of Novell products they were offering.
